They attempt to judge immigrants through see through wall technological devices in the name of post 911, and use it to harass immigrants living their daily lives. Using these devices, living, breathing, eating, sleeping, toilet, household chores, sexual activities, masturbation and body movements of female and male immigrants is prohibited in the name of keeping a strict watch on the movements of immigrants post 911, that is illegal harassment and racism, the exposure of truths that the wrongdoers cannot bear. For every body movement of immigrants inside their owned or rented homes or apartments, neighborhood nonsense and harassment prevails violating immigrants privacy and human rights; whereas the their bony assed lickers, are given these illegal equipments through connivance of cops and their police state who cannot bear immigrants but only want the money, brains of immigrants and other countries. It is all done slyly, supposedly smartly, either loudly or silently; however, they cannot fool all the people all the time.

As their wrong doings of racism and pre and post 911 intolerance of legalized immigrants, specially of nonwhites is exposed, north americans including canadians cannot bear exposure to truths and use see through wall devices to target and harass immigrants in north america, using see through wall devices from neighborhood and through passing cars to see through walls of immigrants homes and drive and bang car doors loudly at appropriate times, wastefully and arrogantly around for every living movement of the immigrants inside their homes, including females and males, including in bathroom and toilet. However, they attempt to judge immigrants through see through wall technological devices in the name of post 911, and use it to harass immigrants living their daily lives. The whole of North America is in heavy debt; however, their media fools them and the world, and they go as merceneries to other countries through their evil colonial tactics of wars, business, and infiltration, to screw the world of its resources, to invite immigrants and then to screw them of their money and happiness through racial profiling on the pretext that obtaining visa is a privilege; however following it with racial harassment is morally abhorent. Their culture teaches them to screw other cultures, look down on other cultures, and to teach other cultures that all cultures are of downtroddens and only North American culture is the right culture! Wow! Nothing more could be farther than truth. This reflects the outright blasphemy and racial obnoxiousness of the North American culture itself! That is the downsliding quality inside of north america, not much of which is portrayed to the outside world through corporate controlled duping mainstream media. While Canada boasts of human rights to the outside world, human rights violations of ugliest nature are committed within Canada itself on nonwhites and legal immigrants whom the whites are incapable of tolerating due to their narrowminded racism. All these are factual happenings to minorities who are nonwhite and newcomers and legal immigrants through isolating them and targetting them. Its a disgrace that in countries of North America, even the phrase 'people of color' is still being used in 21st century! What is the meaning of 'people of color'? Aren't all people humans and don't all humans have red blood in them? Skin color is formed through heriditary, food styles and climatic and weather conditions of snow, cold, mild, warm, tropical, hot, or desert. Are the North American countries that stupid while they boast of high literacy rates. There is a difference between being educated, learned, and literate.
They cannot bear the truths being exposed to them and use their evil intellect to twist the word against those who dare to expose the truths.


SHAME on these anti-christ cops who wail their sirens abusively everytime non-white females and males take showers, move and talk inside their rented and owned homes in daily routine living, in addition to having their henchmen and henchwomen, and often, using their non-white gutless henchmen and henchwomen in cars, transport, shopping centers, neighborhoods, etc, to commit these ugly harassing racially profiling deeds at all times day and night. Using non-whites to engage in racial harassment of other non-whites is an
obnoxiously evil sinister humanely disgraceful intelligent move of the whites well-known for their ugly divide and rule tactics through their non-white henchmen and henchwomen. The white cops and their racial stooges should be debarred from going to churches for their evil deeds.

It's a SHAMEFUL disgrace when the so called protectors of law turn into abusers of law themselves and throw the weight of their uniforms and law around as cowards disturbing the peace in their attempt to perpetuate their jobs and abuse of power. Racially intolerant white cops should be stripped of their uniforms and jobs and be debarred from all religious shrines. The white christians bloatedness has reached its evil peak and is on the downfall at equally great speed corresponding to their twisting the word in their favor
and portraying themselves in good light and non-whites in bad light. While they thrive in their earthly power, when the forces of nature get unleashed on them, they shall be debarred from the book of life. So, they and their henchmen and henchwomen, appear to be very law respecting on the outside; however, they network cowardly to commit sly acts of
provocation to non-whites all the time, which is supposed to be legally acceptable. Is watching through walls of non-whites homes, bugging their homes, working in networking syndicates against them, committing human rights and privacy violations against them, supposedly lawful for the whites? Who makes those laws that favor only the whites? The law itself has racism in its clauses. The ugly inner dirt of the perpetuators of these evil deeds of racism do not deserve to step into religious institutions for their ugly deeds -
such as, if you ain't white, you ain't right? Oh! Really? Nicely dressed, beautiful people, magnificient concrete jungles, clean roads and lawns, sweet polite talkers on the outside, full of ugly stench in their souls, that is the cause of these racist policies that are outrightly biased against non-whites. What a shame!

Most of these ugly acts of dehumanizing racial profiling depict the cowardice of the doers of these deeds in the real sense, and are done at the behind the scenes insistence of the racially intolerant white cops through their frontline stooges. However, without physical evidence, the white cops, security, societies, and their henchmen and henchwomen are laughing sinisterly at their heinous deeds and the legal system seems to support this evil
through its inability to take action without physical evidence. Their racial profiling penetrates public transport systems, shops and stores to do all they can to make the non-whites feel unwelcome in their dehumanizing acts of racial profiling against non-whites and those who don't conform to their nonsense. The white cops, security, and white communities use their henchmen and henchwomen who do just as they are told and from behind
the safety cushion of their oil-guzzling, pollution creating, often dark-glassed vehicles to intimidate and harass non-whites in obnoxious racial profiling that reflects the immoral, despotic, and cowardly behaviour of racially intolerant white cops, security, communities and their dumb henchmen and henchwomen who do just as they are told, fuelled as they are in their racial frenzy, thanks to the racially manipulative corporate controlled media. Racism is immoral and dehumanizing behaviour that reflects the "incapable to perform humanely" quality of those who are racist and are being watched from God's court above in ways they cannot be expected to be capable to perceive yet.

countries who cannot bear non-whites from other countries of origin. Planet Earth belongs to people of Earth. Highly educated people of high intellectual calibres, rich bosses and CEOs, etc, of rich countries are a blotch on humanity and their material levels when they haven't yet evolved to basic human concepts of all humans have red blood irrespective of race.

Racism stems from social attitudes that are perpetuated by racist societies, the media, the authoritarians, and the peers. It's time to say, shame on all those who perpetuate racism and racist attitudes. It's time the white rigid narrowminded racist colonialists go back to where they came from.

This is a follow-up on my previous posting regarding the Ontario Liberal government's nomination of Mr. Raj Anand as Chair of the Ontario Human Rights Legal Support Centre.

In view of the fact that the OHR Commission under Mr. Raj Anand (1988-89) was the subject of allegations of mismanagement and discrimination against visible minorities, when Mr. Raj Anand appeared before the Ontario Legislatue's Standing Committee on Government Agencies for a review of his nomination, he was asked a few questions by the Committee Members.

Thus, about that shady file of wrongdoing and the members of the legislature's fear of a repeat of same, Mr Anand responded:

"All I would say is, what you would hate to see repeated was the subject of an independent report, which found that what you're now repeating did not take place." (See ref. at the end of this text).

The report that Mr. Anand calls "independent" was in fact issued by a public servants following an internal investigation which -for mysterious- reasons- did not (or refused to) hear from key witnesses. That public servant was the Deputy Minister of Citizenship at the time, the very Ministry responsible for the OHR Commission.

Anyway, the NDP and Conservative members of the Standing Committee voted AGAINST appointing Mr. Raj Anand. The Liberals -using their majority on the Committee- rammed the appointment.

Now Ontarians and Canadians have a Chair of Ontario Human Rights Legal Support Centre (a lawyer) who

EITHER:

- INCOMPETENT if he really does not know the difference between an internal report on wrongdoing within a government bureaucracy and an independent report (by a non-government, disinterested and impartial party)

OR

-UNTRUTHFUL: If he in fact does know the difference but have chosen to take liberties with the truth.

Comments:On Thursday March 13, 2008, Ontario Ministry of the Attorney General issued a press release announcing that the Ontario government has nominated Raj Anand as
New Chair For Ontario's Human Rights Legal Support Centre, a component of the Ontario Human Rights Commission

In light of the following background, such move by the McGuinty government raises questions as to the seriousness of Ontario Liberal governments when it comes to human rights in this province.

In 1988, Raj Anand was appointed by the Liberal government of the day as Chief-Commissioner of the Ontario human rights commission. He was hailed as the leader who is determined to revamp an organization saddled with high expectations, low morale and a heavy workload, as the Toronto Star reported on May 25, 1988.

In 1989, Raj Anand had to resign amid allegations of inept management and discrimination within the commission against minorities (Toronto Star, July 23, 1991).

Opposition parties, media and public called upon the (Liberal) government of the day to appoint an independent, open and public inquiry to look into what is going on at the Commission. In the face of such pressure, the government referred the matter to the Legislature’s Standing Committee on Government Agencies and promised full and open hearings.

However, during the Committee’s proceedings, in November 1989, full and open hearings were not allowed. Opposition members stormed out of the Chamber after the Liberal members of the Committee blocked efforts to have the former chief commissioner -Raj Anand- testify (The Ottawa Citizen, Nov. 23, 1989).

Thus, to this day, allegations of inept management, DISCRIMINATION within the commission against minorities and Raj Anand’s role have yet to be examined.

While the Ministry of the Attorney General’s press release did mention that the appointment of Raj Anand is subject to review by the Standing Committee on Government Agencies, the record shows that Liberal governments do not spare any political manoeuverings to neutralize said Committee and render it ineffective.

The Liberal government of 1989 dealt a slap in the face to minorities and to all decent Ontarians who care about human rights through its coverups and hoodwinking and the Liberal government of 2008 dealt yet another slap in the face to same by its outrageous nomination of someone whose role in discriminatory practices and inept managements have yet to be known.

Ontario human rights commission's racism, abuses and wrongs dating back from he 1980's have never been fully probed in spite of the fact that “People's lives, people's careers (have been) destroyed” in the words of Alvin Curling, then Liberal critic for human rights, as reported by the Toronto Star, May 24, 1991 ...

Premier Dalton McGuinty must immediately halt Raj Anand's nomination for now and establish a judicial inquiry to fully and publicly look into the Ontario human rights commission’s wrongdoings and Raj Anand's alleged role. Only after such an inquiry has looked into the matter and issued its recommendations that we could move forward to build a human rights commission and related apparatus that are not contaminated by clouds of serious allegations and political manoeuvring that had left victims licking their wounds. Only then the commission and its branches can aspire to gain the public’s trust.

Comments:I am a member of the "British Group" as Mr. Fong stated in the article on highrise ghettos in Toronto and I am completly offended by his amaturish, unsupported generalization that British Whites (or long established Whites as he put it) avoid living anywhere near visible minorities. First of all, my Fiance is Iranian (a minority) and as far as his claims that desirable housing is occupied by only whites, well I'd like to know how exactly he researched these statistics. Yes, I am White, in fact my entire family are decendants of the United Empire Loyalists who landed on these shores hundreds of years ago and were given land grants by the King of England in order to settle and begin to help form the country we know as Canada today. My ancestors were immigrants too, they struggled to build a life here just as anyone would and when I here someone using a label such as "the British group" and accusing an entire nationality of avoiding minorities and taking over all the desirable housing in toronto I am outraged! My household income is in the six-figure range and yet when I step out into the hallway of my condo building I am greeted by saris, hijab and in the elevator 70-80% of the time I overhear the chatter of a foreign language. So, if British Whites are the only group allowed to live in desirable areas how could one explain the diversity in my upscale condominium highrise? Or the diversity I see walking down the streets surrounding my building? I just feel Whites are all too often villanized in the issue of poverty and equality and I am tired of reading articles like this one.

Comments:I would like to take this time to say I came upon this page surprisingly I hope there is someone who can help me with this out of control Bullying taking place where I work.
I work for Associated Brands LP the Toronto plant and have been an employee for this company for 26 years, and within these 26 years of service I have never seen so much Bullying by certain employees as I have seen in the past three years. This matter is not with myself but with a fellow co-worker and managment has done nothing despite the fact that nurmerous complaints and witness have come forth, I am a union Cheif Steward and have to say that not even the Union has done much to help this indvidual.

I find this outragous it's gotten to the point where the said employee has been given numous disaplains and has been suppened and is still off work due to stress and not being able to control himself any long because he feels that he has to take action to keep his job. The employee is a very hard work so much that managment has said they have no problem with his work it is his conduct with employees that concerns them. But this is all due to certain employees bulling him.

This work stands 6'4" and is a very strong man has a great heart and is a excellant worker I figure that the two mind you only two people bullying him are intimdated by him and the way he works hard and is a fast learner, the bullies also know that if he reacts to the pressure he will get fired and this is what they want. So I am asking for help please tell me who I can turn too to help this person, He will be returning to work soon but my fear is that this will start all over again and this time this employee might not be as nice as before and lose it on these to idiots. Please let me know who I can contact for help or advise on where to go with this situation.

Comments:I am hoping to find someone who will listen to my story and help the injustice as an adoptee and a native. I was torn from my natural parents at the age of four and my younger brother was two. We were adopted out to a very disfunctional and abusive family, which the father was an alcoholic. My natural parents were alcoholics, the reason for us being taken away. Now with my adoptive mother, she was depressive, abusive and still today does not see what she inflicted on my brother was wrong, she actually blames us. I want to know where the justice is and how to overcome that Social Services on the NWT did not care the outcome of native children... I've been subjected to racial abuse from all aspects of growing up in society where they looked down on me for first being native and then being an adoptee... MaryAnn

Comments:there should be more wide spread publication of discrimination against immigrants in Canada - the reason is, we need to convince prospective immigrants with some sort of documentary film or a movie depicting the plight of immigrants here. The measure of success would be felt only when the number of immigrants could be drastically reduced -especially the number of qualified, educated professionals who land up here only to end their lives doing factory lobour jobs, odd jobs and the like where it is hard to find a native Canadian.

My name is mark Everingham, I am a 42 year old white male. My girlfriend is a young black female, who attends college with me. The superintendant in this 8 apartment dwelling is unfortionately, also my roommate. The situation here is like this, we both share this 2 bedroom apartment in Scarborough, Ont. The superintendant here became the super well after we moved both moved in here 6 years ago. This makes for a very high pressured situation for me. He has called my lady a "Nigger whore" right to my face! Help ME! Please! As I know he wants me to resort to violence in order to have me thrown out, but I'm to big of a man for this.
Another black tenant in this building, has also experienced racial slurs, only for the way he dresses. I'll admit that the superintendant did not say this himself, but the slur did come from one of the Super's friends, who was visiting him at the time.
Even though this building is very small, I have attempted to organize a tenant association, as there's strength in numbers.

Comments:I am upset and currently faced an incident of racism of the worst form. I was leaving a situation of Abuse and went to Womens Community House in London and because I come from a higher socioeconomic background I was discriminated against and made fun of and out in a dramatic dilema caused by one of the staff members in their frontline department. She made my life a living hell. She herself discrimated against me because I came from not the stereotypical background.

This is also RACISM and a HATE CRIME. Everyone is entitled to these services if they are fleeing abuse whether it be psychological, emotional, sexual or physical. I have not ever seen such a curruption of frontline staff in womens safe homes. The womens name is Wendy frontline counsellor @ Womens Community and Safe House 101 Wellington St. London Ontario.

I am now trying to pick up the pieces that made my life worse when I encountered this women and some residents at this location whom treated me terribly because of my background of a higher socioeconomical class. In fact it was myself and one lady from Afganistan that bonded well.

Comments:First of all I would liek to say that I stumbled across this web page for a reason. And to my surprise it may be exactly what i was searching for.
I am writning because I have endured Workplace harrassment, and Bullying for two years. Although I am still employed with the same company, I am hurt that I may have to either be let go, or let go myself. Iam sure that the time I have left to do something positive about this ever increasing situation, but will not give me enough time to make a difference for someone else. So I need to act fast.
I have been the subject of harrassment since I started. I work in Long Term Care. Since I work with elderly, disabled, and most time incoherent seniors, I am at their mercy in advocacy. I have no qualms about reporting abuse, or even reporting instances where it could become potentially hazardous for the resident. I am subject to name calling, beligerent statements about my work, derading comments,a dn constantly in the office for discipline- can't get along with coworkers.
How can I resolve this without quiting. How could I initiate change in a poisoned environment? How do i cope with the stress and how do I address the problem? Who do I talk to?

Comments:There is so much obvious hypocrisy in our 'human rights' systems in Canada. I have been struggling with systemic and blatant harassment & discrimination based on both my sexual orientation and gender identity. My experience is that it is very hard to describe the undercurrents of discrimination that lead to psychological crisis. I have complaints against my union and my employer with the Ontario Human Rights Commission, and a complaint against my union with the Ontario Labour Relations Board, for failing to represent me. It is sick how much people get away with. And, it is costing me money, energy, and lots of time to fight these battles. I don't have much money, nor energy. I have time as I am off work sick from these struggles. I like that quote from Malcolm X: there is a growing tension between the two sides. Someday, one day, it will burst and hopefully the people who want equity and justice for all will win. It's not up to the "People in Power" to visualize and develop a safer, more beautiful world. It is up to us. We have hands and minds and create something for ourselves that is brighter, and that increases our standards of living. I guess I'm tired of the reactionary stance I have always taken, and am seeking out more active, self-sustaining ways to create the world I want to live in.

Comments:Does anyone know what ever happened with that case where the Somalian guy was punched in the face by the police and then charged. Remember some tourists had taped it and it was shown on live television and then the Crown tried to still have the guy deported before he sued saying it was her decision whether to depoert or look at the evidence. Man was that ever clearly slimey abuse of the law. That Crown was prepared to deport the man and tell not just Ontarians but the whole of Canada and then some she did not care if he had been the victim, she will do what ever the law allows her to do about it. That was beyond arrogant. Was the cop ever charged? The media never said anymore about it. I guess they don't want the kind of riots they had in L.A. by announcing int he newspapers that the cop was never charged with anything or if he was that he was aquitted by some corrupt judge or rigged jury. I think that someone should demand to know what transpired with that case. I think just the fact that nothing more was said about it is revealing. No apologies from the police, no apologies from the Crown's office for the utter disgusting behavior of that Crown. Clearly demonstrated how the Crown will blindly just go with what the police want in bias. Shows how people get prosecuted and/or deported every day when really it was them that were the victims of the police criminals. I happen to know of this Crown attorney that was sleeping with this cop named Lortie and I bet there is more of that. Our justice system is truly as "just us" system isn't. I wonder why people do not care more? I guess the fact that everytime people try to exercise their right to peaceful protest about police abuse they send out every cop they have and get more from another city if need be to outnumber the protesters. In Montreal they sent ringers into the crowd and everyone, including citizens knows that it was the police who actually threw rocks at the windows as the protest was very organized and it was established ahead of time that there would be nothing broken and no violence. The police sent people into the crowd to start violence and break windows. Even at that you know that they intended to make violence as they did not show up as "crowd control" but showed up in "riot gear". No one pointed this out to the media though. There were 600 protesters by invitation, all peaceful and there were like 1,100 cops. Contrast that with say a "prolife" demonstration you will not see the city agree to the kind of costs they expended on trying to turn a peaceful protest into a riot. Mike Harris did the same thing to OCAP protesters, he sent cops with the express instructions to create a riot and turnt he public against the poverty protesters.
We do not live in a democracy anymore people. Why more people do not see this and are not alarmed by it is what really scares me. Who was it that said;
"Evil happens when good people do nothing"?

Comments:The court ruling that decided that the Security Certificates are Constitutional scares me. I do not like it, I do not trust it and I think the Canadian public is being manipulated by our judicial system.
This would not be such a bad thing if we could trust the police and our judicial system. The truth is we cannot. The laws we have in place now are abused. Like the Anti Organized Crime laws that were passed before this. It is great in theory when they tell us it will be used to stop Organized Crime and Gangsterism but the truth is it is more often abused and used to harm perfectly innocent people or simply to amke the job of the police easy and circumvent Charter Rights. Now all the police have to do is say they suspect you are an 'organized criminal' and your privacy and your fundamental rights are tossed to the wayside. That is scary when you consider the broad definition of "organized crime", two or more people conspiring to commit a criminal offence. The cops can stretch the truth I tell you they are experts at it and our judicial system seems completely inept to address systemic corruption and perjury and witholding evidence by the police forces and the Crowns.The Anti Terrorist laws will institutionalize the racism and ethnic profiling practiced by our police forces. You all think it is fine in the context of a "terrorist" but the real truth is once it is in practice and the public has become complacent about the law, accepting of it, it will be abused and believe it or not it could be you sitting in jail for a dogs age without the fundamental rights afforded everyone else.
I do not trust this and what is more I think that the timing of the judgement with the Supreme Court's ruling on same sex is meant to dampen the outrage of the intellectuals and the left wing. The judicial system "gives with one hand and takes with the other" all within a day. I don't trust and neither should any other Canadian who values freedom and fundamental rights and equal justice for all.

NOT True. Some officers are very sincere, and have no intention of violating your rights.

One of the cops and his pal stopped us as we were walking around the waterfront hotel. Of course they made us look like troublemakers cos we were frisked in front of the major touris area.

OBVIOUSLY, you were scared. But had you reported it, there would be a complaint filed on record.

One of the chink officers, badge number #1705 asked to empty our poskets. We had some money and pot, and hew took about $360 from my boyfriend, all he had left. Told us to be on our way and kept the money and pot. We did not argue cos we though we would get into trouble.

OFFICER BADGE belongs to Terry Yung. there have been some complaints about him, but they were not taken seriously. As you probably know, a rule of thumb is not to complain against a fellow officer.

Later a search on the net revealed he was a constable with the waterfront station. His name Constable: #1705 Terry YUNG PAGER:

HOPEFULLY, a senior member of the force will see this, and maybe investigate his actions.

Of course we are teens and cannot make a complaint. If this guy has ripped you off or if you have been ripped off by other cops in vancouver, you should post it here, and maybe someone will have the balls to file a complaint against the thieves.

NOT LIKELY, if you are a teen you are automatically considered a troublemaker.

This is the officer in question. The officers name is Terry Yung. As a member of the department, I do not wish to make this information public.

I am hoping a senior officer will read this or an independent investigation lauched by the RCMP. There have been many complaints about this officer, and I am sure they are watching him.

Material Facts Relied On:


1.The Respondent, 3M Canada Company Inc. (hereinafter, "3M Canada") brought

an Application pursuant to Section 140 of the Courts of Justice Act, 1990, c. C.43 in

Court File No. 33508, requesting that the Court declare the Plaintiff, Ms. Steward

(hereinafter, "Ms. Steward") a vexatious litigant.


2.Justice Hockin in his August 16, 2004 Order entered on August 16, 2004 granted

the Respondent's request and declared Ms. Steward a vexatious litigant and Order

that she seek leave of the court before instituting any further proceeding against

3M Canada.


3. The 3M Canada's only argument for its section 140 Application was that Ms. Steward's

various issues had already been dealt with in previous forums and Ms. Steward was

seeking to re-litigate the issues in this court.


4. 3M Canada filed with the Court a voluminous amount of documentary evidence from

the various forums to support its position.


5.The documentary evidence file by 3M Canada to support its Application shows that

none of the allegations against 3M Canada was dealt with in any of the previous forums.

In other words, none of the issues raised by Ms. Steward in the various forums were ever

dealt with in the previous forums.


6.The Respondent, 3M Canada's documentary evidence shows that the evidence

relied on by 3M Canada and the Court did not and does not support the granting of its

request made in its Application for an Order declaring Ms. Steward a vexatious litigant

pursuant to Section 140 of the CJA and an Order ordering her to seek leave of the

court before instituting any further proceeding against 3M Canada.


HISTORICAL BACKGROUND:

7.The Union purport to file grievance No. 2-94 dated March 15, 1994 in respect

of Ms. Steward's allegations of harassment and discriminatory treatment by 3M Canada

due to her work-related disability. The Union settled the March 15th 1994 grievance

as per the March 29, 1995 Agreement without dealing with Ms. Steward's complaints.

The March 15th, 1994 grievance was not submitted as evidence in either 3M Canada's

Application Record or Motion Record.

10.The Collective Agreements included in 3M Canada's records show that the

agreements contain a Workplace Harassment Policy. The policy was not utilized by

the Union on Ms. Steward's behalf.

CONCLUSION:


11.Ms. Steward's allegations of harassment and discrimination against 3M Canada

was never dealt with by the Union.


ONTARIO LABOUR RELATIONS BOARD AND ONTARIO HUMAN RIGHTS COMMISSION


1. The Ontario Labour Relations Board (hereinafter, "the OLRB") and the Ontario

Human Rights Commission (hereinafter "the OHRC") proceedings ran simultaneously.

In the proceeding before the OLRB, Ms. Steward alleged that the National Union of

Automobile, Aerospace and Agricultural Implement Workers of Canada (CAW-Canada)

Local 27 ( currently National Automobile, Aerospace, Transportation and General

Workers Union (CAW-Canada) Local 27) (hereinafter "the Union) breached Section 74

of the Ontario Labour Relations Act (hereinafter "the LRA") and 3M Canada violated

Section 70 (Unfair Labour Practice) of the LRA.


12.In the proceedings before the Commission Ms. Steward filed a human rights

complaint naming both 3M Canada and the Union as respondents. Ms. Steward was

represented by Counsel in the OLRB proceeding.


PROCEEDINGS BEFORE THE ONTARIO LABOUR RELATIONS BOARD


13. Ms. Steward alleged that the Union violated Section 74 of the LRA (Union's Duty

of Fair Respresentation) and also alleged that 3M Canada violated section 70 of the

sections 70 and 74 of the Labour Relations Act.

14. Vice Chair M.A. Nairn (hereinafter "Vice-Chair Nairn) dismissed the Section 70

allegation against 3M Canada. Vice Chair Nairn in her reconsideration decision of

October 17. 1997 decision wrote in part as follows:

1.This is an application brought pursuant to section 74
of the Labour Relations Act, 1995. The matter was
dismissed as against the employer, 3M Canada Inc.
although it chose to remain and participate as an intervenor
in the proceeding. The style of cause has been amended
accordingly.

2.For reasons given orally at the conclusion of the consultation
the matter is hereby dismissed.

15. Vice-Chair Nairn did not immediately issue a written decision and Ms. Steward

was placed in limbo. With the assistance of the Ombudsman Ontario, Ms. Steward

was able to obtain a written decision from the Board. Vice-Chair Nairn's October 17,

1997 decision did not provide reasons for the dismissal of the Section 70 allegation

against 3M Canada.


16. Instead of providing reasons for her decision to dismiss the Section 70 allegation

in her October 17, 1997 decision, Vice-Chair Nairn provided her reasons in her

reconsideration decision of August 14, 1998. Vice-Chair Nairn wrote as follows:


1.At the outset of these proceedings the applicant confirmed
that it was seeking a remedy pursuant to section 74 of the
Labour Relations Act, 1995 (the "Act") as against the National
Union of Automobile, Aerospace and Agricultural Implement
Workers of Canada (CAW-Canada) Local 27 (the "Union").
To the extent that the applicant was pursuing a remedy against
3M Canada Inc. (the "employer") it was to have the termination
grievance referred to arbitration, which would affect the employer's
interest. In the result I dismissed the allegation made pursuant to
section 70 of the Act as against the employer. The matter proceeded
on the basis of the allegation of a violation of section 74 of the Act.

17. Vice-Chair Nairn wrongly indicated in her August 14, 1998 reconsideration decision

that the October 15, 1996 Application requested that 3M Canada refer Ms. Steward's

grievance to arbitration. Unfortunately, because Vice-Chair Nairn did not provide

any reasons in her October 17, 1997 decision, but instead provided the reasons for

her dismissal in her August 14, 1998 reconsideration decision, Ms. Steward could not

challenge Vice-Chair Nairn's reasons for the dismissal of the section 70 allegation

against 3M Canada. Basically, when Ms. Steward filed her request for reconsideration

she did not know the reasons for the October 17, 1996 decision until the August 14,

1998 reconsideration decision. The remedies requested in the October 15, 1996

Application reads as follows:

(b) An Order directing that the Applicant be reinstated by
the Respondent Party, 3M Canada Inc. (hereinafter "
3M Canada") in her position as Take Down Operator,
effective immediately.

(d) In the alternative, an Order directing that the grievance
filed by the Responding Party, National Union of
Automobile Implement Workers of Canada (CAW-Canada)
(hereinafter referred to as "the Union") dated June 8, 1995
be referred to arbitration, and the Union bear the Applicant's
cost of independent legal representation at said arbitration.

18. Vice Chair Nairn did not provide reasons for dismissing the section 74 allegation

against the Union either. In essence, Vice-Chair Nairn provide a written decision

(October 17, 1997), with no reason for her decision to dismiss either the section 70

and 74 allegations. Section 70 and 74 of the LRA reads as follows:

Unfair Labour Practice

70.No employer or employers' organization and no person
acting on behalf of an employer or an employers organization
shall participate in or interfere with the formation, selection or
administration of a trade union or the representation by a trade
union or contribute financially or other support to a trade union
but nothing in this section shall be deemed to deprive an employer
of the employer's freedom to express views so long as the employer
does not use coercion, intimidation, threats, promises or undue
influence. R.S.O. 1990, c. L.2, s.65

Trade Union's Duty of Fair Representation

74.A trade union or council of trade unions, so long as it continues
to be entitled to represent employees in a bargaining unit shall
not act in a manner that is arbitrary, discriminatory or in bad
faith in the representation of any of the employees in the unit,
whether or not members of the trade union or any constituent
union of the council of trade unions, as the case may be. R.S.O.
1990, c. L.2, s. 69

19. Had the section 70 allegations against 3M Canada not been dismissed, Ms. Steward

could have been restated to her employment as requested in her Application on the

grounds that 3M Canada had terminated her employment due to disability. Section 96 (4)

of the LRA reads as follows:

Enforcement

96 (1) The Board may authorize a labour relations officer to inquire
into any complaint alleging a contravention of this Act.

(4)Where a labour relations office is unable to effect a settlement of
the matter complained of or where the Board in its discretion considers
advisable to dispense with an inquiry by a labour relations officer, the
Board may inquire into the complaint of a contravention of the this Act


and where the Board is satisfied that an employer, employers'
organization, trade union, council of trade unions, person or employee
has acted contrary to this Act it shall determine what if anything, the
employer, employers' organization, trade union, council of trade unions,
person or employee shall do or refrain from doing with respect thereto
and such determination, without limiting the generality of the foregoing
may include, despite the provisions of any collective agreement, any one
or more of,

(a) an order directing the employer. Employers' organization, trade
union, council of trade unions, employee or other person to
cease doing the act or acts complained of;

(b) an order directing the employer, employers' organization, trade
union, council of trade unions, employee or other person to
rectify the act or acts complained of;

(c ) an order to reinstate in employment or hire the person or
employee concerned, with or without compensation, or to
compensate instead of hiring or reinstatement of loss earnings
or other employment benefits in an that may be assessed by the
Board against the employer, employers' organization, trade
union, council of trade unions, employee or other person jointly
or severally. R.S.O. 1990, c. L.2, s. 91 (1-4).


(5)On an inquiry by the Board into a complaint under section (4) that
a person has been refused employment, discharged, discriminated against
threatened, coerced, intimidated, or otherwise dealt with contrary to this
Act lies upon the employer or employers organization. R.S.O. 1990,
c. L.2, s. 91(5); 1993 c.27, Sched.

CONCLUSION:

20. What 3M Canada's records show is that the OLRB never heard the section 70

allegations against it. Further because the section 70 allegation was dismissed out

right, any allegations against 3M Canada would have been irrelevant since section 74

(Union's Duty of Fair Representation) of the LRA only applies to trade unions. In addition

any evidence of discrimination on the part of 3M Canada would have been irrelevant

as well because again, section 74 only applies to trade unions. Therefore the request

made in her Application pursuant to section 96 (1) (c ) and 96 (5) of the LRA, would have

been a non issue.

21. The OLRB never endeavor to determine whether 3M Canada contravened

section 70 of the LRA because Vice-Chair Nairn wrongly concluded that Ms. Steward's

Application requested as a remedy, that the Respondent, 3M Canada refer her grievance

to arbitration. It is my understanding that Vice-Chair Nairn is no longer a Chair

at the OLRB and is currently an arbitrator.


22. Furthermore, because the section 70 allegation was dismissed without hearing

the allegations against 3M Canada, the dismissal resulted in evidence of collusion

between 3M Canada and the Union being ignored. Counsel for Ms. Steward indicated in

his Application submissions as follows:

12.3M Canada, in collusion with the Union representatives, adopted
the position that if the Applicant were unwilling to make application
for Disability Benefits, and continued to insist that her injuries were
were work-related, she would be required to return to work in a
different position which had already proven unsuitable.

16. Nothing in the Minutes of Settlement prepared by 3M Canada and
the Union addressed the likelihood that the Applicant's proposed
application for long-term disability benefits would actually be denied
or provided a remedy for the Applicant in that eventuality.

23. 3M Canada interfered with the Union's representation of the Applicant by
conspiring and colluding with the Union representatives to contrive a
settlement acceptable to those parties, but not the Applicant.

23. At the time that Ms. Steward filed for reconsideration of Vice-Chair Nairn's

October 17, 1997 decision, she was not represented by Counsel. The allegations

against 3M Canada was never dealt with.

PROCEEDINGS BEFORE THE ONTARIO HUMAN RIGHTS COMMISSION


24.Ms. Steward filed a human rights complaint dated October 16, 1996 against both 3M

Canada and the Union one day after filing her section 70 and 74 Application with the

OLRB. Like her Application filed with the OLRB, Ms. Steward filed one complaint

naming both 3M Canada and the Union as Respondents.

25.The Commission upon receiving Ms. Steward's October 16th, 1996 complaint

assigned filed number SW-2519.

26.In the the Union's reply to Ms. Steward's complaint, the cover letter dated January

14,1997, addressed to OHRC's Ms. Susan Jostman, Manager, Southwestern Region,

the Union's Counsel, Mr. Lewis Gottheil quotes the file number SW-2519, the number

assigned to Ms. Steward's complaint. In the top hand corner of the January 14th, 1997

cover letter, the letter and the accompanying response was received January 16, 1997

and the hand written file number SW-2520 assigned to the Union's response upon its

receipt by the OHRC.

27. What the above mention means, is that the Union received Ms. Steward's complaint

showing file number SW-2519 naming both 3M Canada and the Union as Respondents

in the complaint.

28.At short time thereafter the OHRC notified the Union's Counsel, Mr. Lewis Gotthiel

of the new file number and requested that he quote the new file number SW-2520 in his

correspondence with the OHRC. Mr. Gottheil, in his February 24, 1998 letter to

Ms. Susan Jostman quoted the new file number SW-2520 in his letter addressed to her.

29. A month before Vice-Chair Nairn rendered her written decision of October 17,

1997, Christopher White, Counsel for 3M Canada sent a letter dated September 12,

1997 to OHRC Officer, Mr. Lorne Shipmen indicating falsely that Ms. Steward

had withdrawn her section 70 allegation against 3M Canada. As already mentioned

and confirmed by Vice-Chair Nairn's October 17th 1997 decision and her August 14,

1998 reconsideration decision, Vice-Chair Nairn dismissed the section 70 allegation

against 3M Canada. Mr. White quotes file number SW-2519, the file number

assigned to Ms. Steward's complaint in his letter. Mr. White's September 12, 1997 letter

reads in part as follows:


In the spring of this year there was a hearing date at the Ontario Labour
Relations Board for the Complainant's Application under section
96 of the Labour Relations Act. At that hearing two things relevant
to this preliminary objection occurred. First, the Complainant withdrew
her application against 3M Canada Company, such that we are only a
participant in the Labour Proceeding as an Intervenor. Second, all the
parties have agreed to use the Labour Board's "consultation hearing"
process which is designed to provide either a settlement or a decision
on an expedited basis.


To date the parties have been unable to settle the Application and
two days, October 16 and 17, 1997 have been scheduled for the
continuance (and likely conclusion) of the Labour Board's
consultation hearing.

30.At the end of the consultation hearing on April 18, 1997, it was to resume on

July 10, 1997. The July 10, 1997 consultation hearing was subsequently adjourned

to two consecutive days, October 16th and 17th , 1997. It should be noted that 3M

Canada's response (Form A-36) to the Application is dated March 27, 1997.

It appears that its response was filed three weeks before the April 18, 1997 consultation

hearing and five months after Ms. Steward's October 15, 1996 Application was filed.

The OLRB's Rules of Procedure indicates that the Respondents have twenty days from

the date they receive the Application to file a response.

31. Mr. White's false assertion in his letter of September 12, 1997 to OHRC's Susan

Jostman that Ms. Steward withdrew her section 70 allegation against 3M Canada was

contradicted by Vice-Chair Nairn's October 17, 1997 decision and August 14, 1998

reconsideration decision.


32. Mr. White in his letter dated February 26, 1998 to OHRC's Susan Jostman appeared

to have retracted his assertion that Ms. Steward withdrew her section 70 allegation

against 3M Canada. Mr. White wrote as follows:

Attached please find the Submissions of the Corporate Respondent.
These reflect the Submissions previously made but amended given

the decision of the Ontario Labour Relations Board last fall dismissing
Ms. Steward's Application against both 3M Canada and the C.A.W.,
Local 27.

33. It appears that Mr. White in falsely informing OHRC's Susan Jostman

that Ms. Steward withdrew her section 70 allegation against 3M Canada was confident

that Ms. Steward's lawyer of the time could be convinced to withdraw the section 70

allegation against 3M Canada before the October consultation hearings. As evidence

by Vice-Chair Nairn's decisions, Mr. White was unsuccessful.


34. Ms. Steward filed her human rights complaint on October 16, 1996. However, it took

the Commission sixteen months to render a decision on her complaint. The decision(s)

is dated April 7, 1998. During the sixteen month period, the Commission only

managed to prepare an undated and unsigned Section 34 Case Analysis consisting of

two and a quarter pages in length. Since the Commission did not conduct a mediation

meeting or investigation there was no reason for its original decision(s) to take

sixteen months to render.


35. Both the OLRB and Commission proceedings were being held simultaneously, the

and the records show that 3M Counsel, Mr. White was obviously keeping the OHRC

abreast of the proceeding at the OLRB. As mentioned, Vice-Chair Nairn did not

immediately issue a written decision and Ms. Steward had to request the assistance

of the Ombudsman Ontario to obtain a written decision from the OLRB. At the time,

the time limit for filing a request for reconsideration was twenty days from the date

of the decision (currently fifteen days).

36. Vice-Chair Nairn's reconsideration decision is dated August 14, 1998, indicating a ten

month delay in the release of the reconsideration decision. Ms. Steward's delay in

filing a request for reconsideration was a result of the delay in the OLRB releasing

Vice-Chair Nairn's October 17, 1997 decision.


SECTION 34 CASE ANALYSIS


37. As mentioned earlier, the OHRC assigned a new file number SW-2520 to the

Union's response. However, the OHRC only prepared on Section 34 Case

Analysis. The Section 34 Case Analysis was only prepared for SW-2520, the new

file number assigned to the Union. The OHRC did not prepare a Section 34

Case Analysis for file number SW-2519, which names 3M Canada as a Respondent.

There is no Section 34 Case Analysis in either 3M Canada's Application Record

Motion Record for file number SW-2519.

38. The problem with the new file number assigned to the Union (SW-2520) is that no

complaint against the Union existed under the SW-2520 file number. Therefore, the

OHRC purport to prepare a Section 34 Case Analysis under file number SW-2520

and a complaint under the said file number didn't exist. In fact this is confirmed by the

OHRC in its Reconsideration Report in (undated and unsigned) which the

OHRC indicated that it did not separate Ms. Steward's complaint. The OHRC

indicated as follows:

The facts do not reveal that the complaint was separated. The
evidence shows that consistent with the Commission's operating
procedure the complaint was identified through a different set of
numbers and served separately on the named parties.

38. As already mentioned, the Union's Counsel, Mr. Gottheil's letter of January 14, 1997

quotes file number SW-2519, the file number the OHRC assigned to Ms. Steward's

complaint naming both 3M Canada and the Union as Respondents. Given Mr. Gottheil'

letter of January 14th, 1997 quoting file number assigned to Ms. Steward's complaint

(SW-2519) it's evident that the OHRC did not serve the Union a separate complaint

indicating file number SW-2520.


39. Given the OHRC confirms in its Reconsideration Report that it did not separate

Ms. Steward's complaint, this means that the Commission separated the Union's

material from file number SW-2519 by assigning a "different" file number (SW-2520)

to the Union's material filed with the OHRC. The OHRC then subsequently relied solely

on the file it created exclusively for the Union to arrive at its decision to dismiss

Ms. Steward's complaint under Section 34 (1)(a) of the Code.


40. If one were to look into file number SW-2520, one would not find Ms. Steward's

October 16, 1996 complaint or any material from Ms. Steward or 3M Canada under

the said file number.


41. The Union submitted as a response to Ms. Steward's complaint an identical copy of

its response to Ms. Steward's Application before the OLRB. The OHRC as indicated

in its Section 34 Case Analysis relied on the information contained under the new file

number assigned to the Union, SW-2520, which only contained the Union's response

(Union's response to Application filed with OLRB ) and correspondences.

42. The Commission rendered two April 7th , 1998 decisions. The cause of style

in the decision under file number SW-2519, names 3M Canada only as a Respondent.

But the complaint under the aforesaid file number names both 3M Canada and the Union

a Respondents.

43. The other April 7th, 1998 decision, the cause of style names the Union only as a

Respondent. The file number quoted is SW-2520. As mentioned was no complaint

under this file number since the Commission did not separate Ms. Steward's complaint

of October 16, 1996.


44.Where as the OHRC rendered two April 7th 1998 decisions for each file number,

it only rendered one reconsideration decision dated June 13, 1998. The style of cause

names 3M Canada as the only respondent and quotes file number SW-2519, the file

number the OHRC assigned to Ms. Steward's complaint that named both 3M Canada and

the Union as a respondent.

Comments:Yesterday ( Sept 15th, 2004 ) my girlfriend ( 32 yrs old ) was arrested for assault against a former employee - the Arresting officer felt due to the size and muscular build of my girlfriend that she must have committed this crime. This is not what is most upsetting - she then asked my girlfriend to answer some questions - when my girlfriend responded that nothing had occurred between her and the plaintiff the Arresting officer threw handcuffs on her saying that she was unwilling to cooperate - she then threw her up against a wall in a holding cell ( which dislocated her shoulder ) she also refused to let her make any phone calls or use the washroom for 3 hrs. This kind of conduct is disturbing to imagine. It's upsetting to think our tax dollars pays to have this kind of misbehavior in our Law system.

This "Shooting Was NOT Racial Profiling" rant gave Bromell and his co-pilot, former Mojo newsreader Ross MacLeod, a chance to assure us that Brookes was "an absolute scumbag" and "a complete idiot" who "had some significant issues" and deserved what he got fair and square, whatever colour he may have been.

We heard this all again on the half-hour, when the Mojo news department repeatedly led off with clips from the show: "No Profiling In Police Shooting, Bromell Says." Is there an echo in here?

Bromell admitted no one had as yet said the police were racist in shooting Brookes — but be informed, Mojo listeners, "we predict" it's only a matter of time before "some real morons will be bleeding and complaining" about the racial slant in the takedown.

I can not help but marvel at the notion that someone this stupid actually gets paid for his ignorant and irrelevant commentary. I guess, like the new era of "trash television" with it's Maury's and Springers and Reality TV shows we are truly in the era of "trash radio". I guess this radio station can not afford the air rights to Howard Stern or something. Imagine that, after being given his walking papers by the Union Craig Bromell is now "the poor person's Howard Stern".

Comments:While crossing from Alaska / Canada / to Washington. At the border, my friend was harrassed by the Border patrol. They kept him there for 2 days. Before it was over an officer hit my friend from behind. My friend turned and defended himself. Long story short. Officer hospitalized, friend in jail for being harrassed by this officer. Please if there is a witness please come forward. Need advice.
The sad part is that this could ruin my friends life. With a clean past to face this, is unheard of. Lost.

Comments:My family and I are constantly being harrassed by the police and the people in our neighborhood because we have horses. They are ebing taken care of proplerly and I do not see the problem. They get out of their fence sometimes and are on the neighbors lawn for maybe a toatal of 2 or 3 seconds....now why is it that we get threatened to have our horses taken away or us charged/thrown in jail if we do not get rid of them but yet they never get in trouble for harrassing us or letting their dog eat our garbage crap in our yard and bite at my horses? I need help and so does my family. It is tearing us to pieces. Please llet me know someone who I can talk to to get them to stop. Thanks

Comments:What hypocrites the government of Canada is! I should think that they would look after the human rights violations in their own back year before they go criticizing another country. They are prepared to set sanctions against Iran for one injustice, against one woman.No one lecture me, I understand the 'freedom of press implications' but at the end of the day it is one woman killed by a justice system. Gee, wonder why the likes of Robin Voce, Fionna Stewart and Pierre Lizotte didn't get the government's attention. It took over 9 years to get someone to look into Dudley George's killing. There are many, many more which would make me too sick to mention. Pefectly innocent people killed by the police and our "just us" system but the Federal Government could care less.
Anyone remember the Amnesty International report on the US justice system in regard to Human Rights violations?
"...and the weak shall be preyed upon by those to whom they had looked to for protection...and worse yet they will not be believed..as their abusers will hide behind their nation's reputation as being at the forefront of Human Rights"..that about sums up Canada..the big lying, hypocrite it is!
Damn hypocrites!! They make me so angry! I don't see anyone being criminally charged for assaulting that poor Somalian guy and then terrorizing him with criminal charges for something he did not do....do you? In fact I can not think of a single murdering or human rights abusing cop or official that has been convicted in the last twenty years...can you? Damn hypocrites!!!
