McCutcheon & George McCutcheon minors over the age of fourteen years & the petition of Sarah McCutcheon the mother of Rachel A. McCutcheon a minor under the age of fourteen years all residing in the Town of Enfield in said County praying that Ira B Meeks of said Town of Enfield might be appointed Guardian of the said minors for the purpose of taking care of the persons & estates of said minors & on reading & filing the bonds of said Ira B. Meeks executed to each of said minors with sufficient sureties as required by law & the written consent of the said Ira B Meeks to act as such guardian. It is ordered that the prayer of said petitioners be granted & that Letters of Guardianship issue in persuance thereof Alfred Wells County Judge The people of the State of New York to all whom these presents may concern and greeting: Know ye that at Ithaca before our County Judge of our County of Tompkins on the 27th day of September in the year of our Lord one thousand eighteen hundred & forty nine came Elizabeth J McCutcheon & George McCutcheon minors over the age of fourteen years & Sarah McCutcheon the mother of Rachel A McCutcheon a minor under the age of fourteen years all residing in the Town of Enfield in said County & prayed that Ira B. Meeks of the Town of Enfield in the County of Tompkins might be appointed guardian of the said minors and each proceedings were thurore (thoroughly) heard that the said Ira B. Meeks was considered a proper person as to Guardian as aforesaid & thereupon & in persuance of the Court in each case made it was ordained by our said County Judge that the said Ira B. Meeks be appointed Guardian of said minors upon executing the bonds signed in each case, and the said Ira B Meeks having together with Parden Broner his surety executed such bonds in the fiscal sum of two hundred dollars to each of said minors. Therefore we certify that the said Ira B Meeks is the duy (duly) appointed Guardian of the said minors for the purpose of taking care of the persons & estates of the said minors until the said minors shall expectively arrive to the the age of twenty one & fourteen years or until another Guardian shall be appointed. Freer Surrogate, Robert McCutcheon & Peter Snyder executors named in the last Will & Testament of George McCutcheon late of the town of Dryden in said county deceased appeared for the purpose of proveing (sic) & haveing (sic) the said Will recorded according to law, and made satisfactory proof that a citation had been served according to law on all the heirs of the said deceased. An instrument purporting to be the last Will & Testament of George McCutcheon bearing date of the 26th day of October in the year 1841 was produced in court and shown to each of the persons sworn as witnesses as herein after mentioned. Which said last will & testament is in the words & figures following viz The last Will & Testament of George McCutcheon of the town of Dryden in the county of Tompkins & state New York. I George McCutcheon being of sound mind & memory. Blessed be almighty God for the same. do make & publish this my last Will & Testament in manner following that is to say First I order & direct all my just debts & funeral expenses to be paid out of my estate by my executors herein after named. Secondly I direct all the residue of my estate and property of whatever name or kind, including the advances herein after mentioned to some of my children as an advance towards their portions and all which shall be hereafter be advanced to any of my children or to the children of my two deceased Daughters Jane & Anna to be divided Page 344 into 12 equal parts. And I give devise & bequeath to each of my children to wit Robert Peter Philip George Andrew John Aaron Nancy Elizabeth & Mary one equal twelfth part or share thereof. And to the children of my deceased daughter Jane one twelfth thereof to be equally divided between them and to the children of my deceased daughter Anna one twelfth thereof to be equally divided between them. And in case of the death of any of my said children in my life time I direct the share of each child to be paid to his or her lawful heirs. Thirdly my son Robert has received of me the sum of one hundred & eighty three dollars. My son Peter the sum of Two hundred & eight dollars. My son Phillip the sum of Three hundred & fifteen dollars. My son George the sum of Two hundred & eighty eight Dollars. My son Andrew the sum of Two hundred dollars. My son Aaron the sum of Seven hundred dollars. My daughter Mary Persons the sum of Ninety two dollars. And my Daughter Elizabeth Snyder the sum of Twenty Dollars. All of which sums are to be considered and accounted as part of their respective shares & portions under this my Will. My son John has lately received from me the sum of Five Hundred dollars, but the same was in part for services rendered by him for me and is not to be considered as a part of his share or portion under this my will. No interest is to be computed on the above mentioned advances nor upon any advances which may be hereafter made to any of my said children or grandchildren. Lastly, I do hereby appoint my trusty friend William Cobb & my son Robert McCutcheon & my son in law Peter Snyder all of the town of Dryden Page 345 aforesaid executors of this my last will and testament. Hereby revoking all former Wills (and Testaments) by me made. In Witness whereof I have hereunto set my hand & seal this twenty sixth day of October one thousand eight hundred & forty one his George + McCutcheon mark The above instrument consisting of one half sheet was then & there signed by the above named George McCutcheon the testator in the presence of each of us and the said testator then & there declared the same to be his last Will & Testament and we at his request have hereunder set our hands as attesting witnesses in the presence of the said testator George Robertson of the Town of Dryden Henry B Weaver of the Town of Dryden Ezra Weaver of the town of Ithaca in the County of Tompkins being duly sworn deposes & says that he was acquainted with George McCutcheon in his life time that he understands the said George McCutcheon departed this life on or about the 14th day of October last that he was about 86 years of age as deponent is informed. That deponent was well acquainted with George Robertson & Henry B Weaver the subscribing witnesses to said will in their life time. That said witnesses have both departed this life. That deponent is acquainted with the hand writing of both said witnesses and that the signature of (both) each as a witness to said will is the genuine hand writing of each and of which he entertains no Page 346 doubt. Also that William Cobb exr named in said will is dead. Ezra Weaver Subscribed and sworn this 31st day of December 1846 before me George G. Freer Surrogate Amasa Dana Esqr of Ithaca in the county of Tompkins being duly sworn says he was not acquainted with George McCutcheon deceased in his life time except he was called to where he resided in Dryden to draw his will and he believes he had seen him before that time. That deponent drew the instrument now shown him purporting to be the will & c of said deceased at his request. Deponent is a lawyer. Deponent understands he believes the formal requisitions of the statute in reference to the execution of wills and he has no doubt all those requisitions were complied with in the execution of the will of said deceased. That he saw the subscribing witnesses to said will sign their names as such and that he also saw the testator execute said will. That said witnesses as deponent is informed and verily believes are both dead. That the testator at the time he executed said will was of sound mind & memory and deponent has no doubt that he was not under any restraint. That deponent has now inspected said will and he is confident it has not been altered in any respect whatever since its execution by the testator. Subscribed & Sworn this 31st day of December 1846 Amasa Dana before me Geo G Freer Surrogate The foregoing proof and examinations taken before me the surrogate aforesaid at the time and place first mentioned and the deposition of the respective Page 347 Witnesses were by them subscribed after having been carefully read over to them. | Comments: | I am a volunteer with the Marshfield Pioneer Cemetery in Coos Bay, Oregon. I was doing a bit of "reconnaissance" for a friend in the Sons of the Union Veterans of the Civil War, Harold Slavik, who does graves registration. I came across a local newspaper article mentioning Alonzo McDougal as a Civil War veteran. Alonzo is the son of David McDougal, grandson of John, and, I believe, a relative of yours. He was buried in the Sunset Memorial Park, Coos Bay. He has no headstone to mark his grave, and we would like to request a G.I. headstone for Alonzo. The application will be most successful if our documentation is as complete as possible. I found your site at http://homepage.eircom.net/~lindaohdsl/persons.html. It was very helpful as it listed a birth date for Alonzo. Do you have any source or documentation confirming this date that you could share? His date of death is April 28, 1933. | Comments: | I am a grandson of Bertha Bock, nee Zurbrick, of Lancaster, NY. She married Rev George M. Bock in 1918. She died July 1964. She had a brother Irwin or Irving - we called him uncle Pete -he worked for Kleinhans, a mens clothing store in Buffalo, NY well into his 80's. He had married but had no children. When I was small Bertha lived on Lake Ave. in Lancaster taking care of 2 elderly sisters, Libby ( Elizabeth- I think ) & Rose. Both were blind and were in their late 90's when they died in the 1960's. Wagner was their surname and they were Bertha and pete's aunts but I'm not sure exactly how related. Bertha has 1 daughter still alive, Elizabeth, (Betty) she is in her 80's. My mother, Grace was the oldest of Berthas 3 children. Austin the youngest is also gone. | Comments: | My grandfathers (son of Elsie Sommer Zurbrick) obituary per "The Online Edition of the Durango Herald from Durango, Colorado" John Henry Zurbrick (6/9/2006) Durango resident John "Outhouse" H. Zurbrick died at Mercy Medical Center on Wednesday, June 7, 2006. He was 76. His family said Mr. Zurbrick moved to Durango in 1984 to live out his life's dream. He enjoyed hunting, fly fishing and spending time with his friends. The Tuesday Safety Meetings held at the Diamond Belle were one of the things that he enjoyed. Mr. Zurbrick was born on April 6, 1930, in Pontiac, Mich. He served in the Army. Mr. Zurbrick is survived by his sons Kirk Zurbrick, Steve Zurbrick and Michael Zurbrick; and daughter Kristine Carr. Cremation will occur and his ashes spread in the places he loved most. |

We found some papers regarding him, and I was wondering if there were any relatives. I know all Aunt Edna's sons are deceased, and I know Jimmy and David have children, but I don't know anything about them. We had such a large, close family back then. Edna's mother, Anna Near, had at least six children, and they all lived near each other. She was a matriarch to the nth degree. She lived to 96 and just loved to entwine herself in the lives of all her children, grandchildren and great grandchildren. It was quite a soap-opera life. | Comments: | Linda, There was a Steve back in 1999 who refences his Stewart ancestor, the son of Hosea Stewart. He states that the death cert stated his mother was Adelia Aldridge (Aldrich). However, he states the birth information for Adelia shows she was too young to have been married to Hosea. He also states that Phebe Aldrige was married to someone else. My grandmother is Helen Maxwell-Williams, and she is a professional genealogist. However, she does not have all of her information anymore, since she is getting up on years. She had information that Hosea was indeed married to Phebe, and I believe it was on her great-grandmother Alvira's death certificate. Have you kept in touch w/ Steve? Our problem is that the Zurbricks we know from our family are very close mouthed and don't want to let the right hand know what the left hand is doing. I have info going back to the turn of the century and before-- and some photos. The family in Texas let me know about a Zurbrick listed in Rutherford B Hayes genealogy and I have a copy of that listing. Also, part of the family moved to the Milwaukee area under the name Zerbrick (a lot of them couldn't spell well being from pre-1900, you know) and there have been branches in Winnipeg Canada. | Comments: | I got much new information about the Judd family.Thank you! I can give you a little more about my g-g grandfather, Merrill Stewart, son of Hosea Stewart. He was born July 3, 1833, not 1838, he died Jan 5, 1918 in Alexandria, Monroe, IN. He married 1855 to Barbara Ellen Lingenfelter, born April 4, 1837, died April 17, 1906. He spent much of his life as a stagecoach driver in Western PA. His death certificate gives his mother's name as Adelia Aldridge, not Phebe Aldridge. Whichever the case, she was certainly the daughter of Turner Aldridge, Quaker missionary and founder of Gowanda, NY. I am still trying to resolve this problem, as the birth date for Adelia makes her too young, while Phebe is known to have married someone else. |
