Comments:Blue Water Navy REQUEST FOR ASSISTANCE Senate Bill S1629 will make offshore veterans of the Vietnam War eligible for health care and compensation if they currently have disabilities from Agent Orange/dioxin causes. If everyone could email, fax or visit their Senator and Representative requesting that they support this Bill (and its House mirror Bill), they would be hearing from the Grass Roots that there is support for veterans rights and promised benefits. This Health Care and Compensation was granted to us by the Agent Orange Act of 1991, but illegally taken away by the VA in Feb. 2002.

September 28, 2011 Washington, DC – U.S. Senators Kirsten Gillibrand (D-NY) and Lindsey Graham (R-SC) introduced legislation to ensure that more than 250,000 Navy veterans from the Vietnam War exposed to the powerful toxin Agent Orange will be eligible to receive the disability and health care benefits they have earned for diseases linked to Agent Orange exposure. During the Vietnam War, the U.S. military sprayed approximately 20 million gallons of Agent Orange in Vietnam to remove jungle foliage. This toxic chemical had devastating effects for millions serving in Vietnam. In 1991, Congress passed a law requiring the Veterans Administration (VA) to provide presumptive coverage to Vietnam veterans with illnesses that the Institute of Medicine has directly linked to Agent Orange exposure. However, in 2002 the VA determined that it would only cover Veterans who could prove that they had orders for “boots on the ground” during the Vietnam War. This exclusion affects as many as 250,000 sailors who may have still received significant Agent Orange exposure from receiving VA benefits. “Because of technicality in the law, hundreds of thousands of American veterans are being denied the benefits they need and deserve,” Senator Gillibrand said. “Our government must fulfill its commitment to the service members who have fallen victim to Agent Orange-related disease and enact new legislation that will provide our vets with the disability compensation and healthcare benefits they have earned. Agent Orange is a very difficult chapter in our nation’s history. It is time that we correct the errors of the past.” “This is a legacy issue that needs to be dealt with,” said Senator Graham. “There are Vietnam vets who are suffering from Agent-Orange related illnesses and we need to ensure they are getting the care they need. It’s now time to ensure the government takes care of their needs which were incurred during their defense of our nation.” During Vietnam, the U.S. military sprayed 20 million gallons of Agent Orange. Blue Water Navy Vets – veterans who were on duty in the waters around Vietnam, but did not have “boots on the ground” – were often exposed to Agent Orange on a daily basis. Studies have shown that Agent Orange contaminated the water sources on ships, affecting veterans onboard ships or aircraft that transported barrels of Agent Orange, and ships and aircraft deployed in close proximity or even downwind from Agent Orange drop sites. A May 2011 report by the Institute of Medicine established several “plausible routes” for Agent Orange exposure through the water distillation process aboard Navy ships and through the air. In 2010, a study by the Institute of Medicine cited exposure to Agent Orange resulted in an increased chance of developing serious heart problems and Parkinson’s disease. A 1990 study by the Centers for Disease Control and Prevention (CDC) showed Vietnam veterans had a rate of non-Hodgkin's lymphoma 50 percent higher than the general population. Agent Orange is linked to a range of other diseases, including several blood and respiratory cancers, type II diabetes, prostate cancer and more. In 2005, the VA’s former Director of Environmental Agents Service Dr. Mark Brown publicly acknowledged that there was no scientific basis for the exclusion of Blue Water Vietnam veterans, but the VA has continued to refuse these veterans the presumptive benefits Congress initially intended. In his article in the Journal of Law and Policy, Dr. Brown wrote, “Science does not back up the VA’s policy on the Navy.” Senators Gillibrand and Graham introduced the Agent Orange Equity Act of 2011, which would clarify the existing law so that Blue Water veterans would be fully covered by the VA if they served within the “territorial seas,” or approximately 12 miles offshore of Vietnam. The bill would make it easier for the VA to process Vietnam War veterans’ claims for service-connected conditions and alleviate a portion of the VA’s backlog by extending presumptive coverage of Agent Orange benefits to these veterans.

Comments:(WASHINGTON D.C.) - A New York senator will soon introduce a short and simple bill into Congress that could have a large and far-reaching effect on tens of thousands of Vietnam War veterans and their families. According to Louisiana attorney John Wells, the proposed law would extend the presumption of exposure to Agent Orange to certain servicemembers who served aboard vessels at sea - the so-called Blue Water Navy - during the Vietnam War. As the law now stands, only troops who served ashore "in country" or aboard river boats in Vietnam are entitled to compensation from the Department of Veterans Affairs for a number of ailments, including cancer, linked to exposure to the toxic herbicide. Wells, a retired Navy Commander, is the director of legal and legislative affairs for the Blue Water Vietnam Veterans Association. He spoke of the proposed legislation at a meeting of The American Legion's National Legislative Commission during the organization's 93rd annual National Convention in Minneapolis. Wells explained the bill - "The Agent Orange Equity Act of 2011" - by reciting the "elevator speech" he employs to educate members of Congress during his periodic trips to Washington. "Our association is trying to extend the exposure presumption for Agent Orange from the current ‘boots on the ground' to at least the territorial seas of the Republic of Vietnam," he said. "This would encompass the ships that were outside of the riverines but were actually very close to shore providing support to the troops ashore. "What happened was that we would get a discharge of sediment that contained Agent Orange out into the South China Sea. (Ships there) would then bring the sediment into their distilling systems that changed salt water into potable water and the sailors would drink it. The Australians discovered back in 2002 that the Agent Orange in the salt water was actually co-distilled - not removed. So, these folks were drinking an enhanced Agent Orange cocktail, as it were. This was confirmed in an Institute of Medicine report that came out just this past May. The Institute of Medicine also found that there was a plausible pathway both by wind drift and by river discharges for Agent Orange to get into the South China Sea. As a result, we have a higher cancer incidence (among those ship's crew members theoretically exposed) than those troops who were ashore. The Australians, who have been paying Agent Orange-related benefits to their Blue Water Navy sailors for years, proved that in a study back in 2005." Wells said he ends his short presentation with an appeal to his target member of Congress to support the bill. One who was impressed by his organization's argument was U.S. Senator Kirsten Gillibrand, D-N.Y. She is expected to introduce "The Agent Orange Equity Act of 2011" shortly after Congress reconvenes in September. Wells said the bill has drawn bipartisan support from several co-sponsors.

I had near 300 hours of condition 3 combat watches in the Gun Director just aft of the after stack. I had a problem with a heart attack not more than a couple of months after my last watch. i want to compare notes with others exposed to nox, sox, chrome, vanadium, arsenic and other toxics from the stack gas given off from the firing of residual fuels, also known as bunker c, or navy #6. I did not hear one negative comment and all left with a renewed spirit for the Assoc. One of the most important events of the reunion was the christening of the trailer. (we have been in one parade already and the response was incredible). The trailer is a testimony of the great men that served on a great man o war. 2012 will come quickly so please plan to attend the reunion in Chasn. We are "coming home!"
